Justice D. O Oluwayemi of a Lagos High Court, Igbosere, on Monday, granted the application for extension of time for expiration writ of summon in a suit filed by Ojukwu Transport Limited, against Bianca Ojukwu
Justice Oluwayemi, further granted the claimant's second application, of an order that the writ of summons, statement of claim and its accompanying processes be served on the defendant, by posting same at the entrance gate of the premises at 29, Oyinkan Abayomi Drive (formerly Queens Drive) Ikoyi, Lagos.
Ojukwu Transport Limited, through its counsel, Ike Ubahakwe, in motion exparte prayed the court to extend the writ on summons, on Bianca, after the expiration of the first writ of summon, over the property situated at 29, Oyikan Abayomi Drive, formerly Queens Drive, Ikoyi.
"It took some time and concerted efforts on our part to track this file and by this time, the writ of summons had expired. Thus, it was impossible for us to bring our application for renewal before the expiration of the life span of the writ of summons" he said.
In her short ruling, Justice Oluwayemi, said "I hereby grant all your prayers of writ on summon and also to post same on the defendant's entrance gate".
She adjourned the matter to June 23, 2014, for report of service and continuation of hearing.
