Ilaje-Ese Odo bye-election: Court fixes May 19 to hear LP suit

The Federal High Court sitting in Akure, the Ondo State capital has fixed the 19th of May, to hear a suit filed by the Labour Party challenging the decision of the Independent National Electoral Commission, INEC on the "inconclusive" Ilaje-Ese Odo bye-election.

The Labour Party which is dissatisfied with the position of INEC on the election, had filed an ex parte application dated April 14, 2014 and prayed for an order of court granting leave to serve its originating processes and all other processes in the case on the commission and other defendants in the suit in Abuja, outside the jurisdiction of the court (Ondo state).

In the substantive suit, with number PHC/AK/CS/28/14, the party, had sued INEC and six other political parties, seeking for the determination and interpretation of the electoral acts whether the returning officer in the just concluded National Assembly election has the power to declare the election inconclusive after the conduct of the poll.

Mr Banjo Ayenakin who held brief for the suit filed by Dayo Akinlaja, SAN while moving the ex-parte application said the motion containing two prayers was brought under order 6, rule 13 and 17 of the Federal High Court (civil procedures) rules 2009 and the inherent jurisdiction of the court.

Aiyenakin urged the court to grant leave to the originating processes on the 1st, 3rd, 4th, 5th, 6th, 7th and 8th respondents in Abuja.

The Presiding Judge, Ishaq Sanni after listening to the prayers of Aiyenakin granted the party's request to serve originating processes on INEC, the election's returning officer, Prof Babatunde Adeyemi and 6 other political parties that particpated in the election.
